Reserved Matters & Discharge of Conditions
An Approval of Reserved Matters application is only necessary when outline planning permission for a development proposal has been sought and granted by the Local Planning Authority. This application process cannot be used independently as a substitute for planning permission.
Outline planning applications are typically submitted to determine whether the general concept of a development is acceptable, helping to establish viability early on. Specific details, known as ‘reserved matters,’ can then be finalised at a later stage. These reserved matters include important elements such as:
- Appearance
- Access
- Landscaping
- Layout
- Scale
The details submitted in a reserved matters application must align with the original outline approval, including any conditions attached to the original permission. If your proposals have changed from the approved plans, you may need to apply again for either outline or Full planning permission.
Planning conditions are often attached to planning permissions to regulate and control how a development is carried out, aiming to enhance the quality of the project by addressing potential negative impacts. These conditions may regulate the use or development of the land.
Typically, and in order to commence your development, you may need to apply for the discharge (approval) of these conditions. Any application must explain and provide detail as to how you plan to meet the conditions and include supporting documentation to demonstrate compliance. This is considered to be a separate application to the original planning permission however, a single conditions application can cover any number of conditions from the permission.
Planning conditions are typically set-out in four categories. The category of the condition indicates at what stage of development it should be discharged. The four main categories of planning conditions are:
- Pre-Commencement
- Pre-Occupation
- Compliance
- Bespoke Trigger
